E-2 business plan for a franchise
A franchise comes with a brand, a system and a disclosure document. The plan turns those into evidence about your business.

Short answer
An E-2 business plan for a franchise uses the franchise disclosure document as its backbone. Item 7 gives the estimated startup cost, Item 6 the ongoing fees and Item 12 the territory. The plan then shows what the brand cannot: that you develop and direct the business and that it can grow beyond supporting your family.
What do officers look for in a franchise E-2?
The E-2 criteria in 9 FAM 402.9 are the same for every business. A franchise changes how three of them are shown.
You direct the business
Guidance looks for an investor who develops and directs the enterprise, usually through at least 50 percent ownership or operational control. A franchise agreement sets brand standards. The plan shows the decisions that stay with you: hiring, local marketing, operations and finances.
The investment matches the real cost
Officers weigh the investment against the cost of the business. For a franchise, that cost is more than the franchise fee. It includes buildout, equipment, opening inventory and working capital.
Fees come out before profit
Royalties and marketing fund contributions are paid from revenue. Projections that leave them out overstate income, and marginality is judged on what remains.
How does the franchise disclosure document feed the plan?
The Federal Trade Commission's Franchise Rule sets the timing. A franchisor must give you its franchise disclosure document at least 14 calendar days before you sign or pay. It has 23 items. These are the ones a business plan uses most.
| Item | What it discloses | Where it goes in the plan |
|---|---|---|
| Item 5, Initial fees | The franchise fee and other fees paid before opening | Use of funds |
| Item 6, Other fees | Royalties, marketing contributions and other recurring fees | Operating costs in the projections |
| Item 7, Estimated initial investment | The estimated total cost to open, shown as a range | Startup budget and investment total |
| Item 11, Franchisor's assistance and training | Training, systems and opening support | Operations plan and opening timeline |
| Item 12, Territory | The area your location can serve | Market analysis |
| Item 19, Financial performance representations | Sales or earnings data, if the franchisor chooses to provide it | Benchmarks for revenue assumptions |
| Item 20, Outlets and franchisee information | How many locations opened, closed or changed hands | The track record of the system |
The disclosure document describes the whole system. The plan applies it to your location, your numbers and your hiring.
What should the use of funds show?
Guidance defines the cost of a new business as the actual cost to make it operational. It suggests showing that cost with invoices, contracts and estimates. Item 7 ranges are a starting point. Your own quotes, signed lease and paid invoices replace them where you have them.
Two rules in 9 FAM 402.9 shape the table. Equipment and inventory on hand count toward the investment. Lease payments count only for the amount paid in one month, unless rent was paid in advance.
Guidance also notes that unverified financial statements based only on the applicant's own information are normally insufficient. That is why a franchise plan ties its numbers to documents.
How does a franchise plan show it is more than marginal?
Guidance describes a marginal business as one that can only provide a minimal living for the investor and their family. The capacity to do more should generally be realizable within five years.
A franchise plan shows that capacity in three places. The five-year projections deduct royalties and marketing fees. The hiring plan shows roles added year by year. Where the franchisor provides Item 19 data, the plan uses it to check that revenue assumptions are realistic.
Example
An investor opens a fitness studio franchise. The plan lists the paid franchise fee, the signed lease and the equipment invoices, then builds five years of projections net of royalties. It adds front desk and coaching staff as membership grows.
What to have ready for your plan
The plan is built from your confirmed information. For a franchise, the most useful documents are the franchise disclosure document, the signed franchise agreement or the franchisor's approval letter, your lease or letter of intent, quotes and invoices for buildout and equipment, and records of the funds you have transferred.
Only you can provide these. Until you have them all, Item 7 estimates give the plan a documented starting point.

Questions, answered
What is the best franchise for an E-2 visa?
VisaPlans does not rank or recommend franchise brands. Officers assess your investment, the business and your role, not the brand name. Your immigration attorney and a franchise attorney can review a specific opportunity.
Does the franchise fee count toward the E-2 investment?
Funds committed to the business and at risk of loss can count. The plan lists the franchise fee in the use of funds with everything else it costs to open. Your immigration attorney confirms what counts in your case.
Does VisaPlans need my franchise disclosure document?
It helps. VisaPlans uses details from Items 5, 6, 7 and 19 when you have them. Under the FTC Franchise Rule, the franchisor must give you the document at least 14 calendar days before you sign or pay.
Does a franchise make the E-2 easier?
No business type guarantees an outcome. A franchise gives you documented costs and an operating system. Officers still assess your investment, your role and the business on their own facts.
